German Man Sentenced for Ordering 100 Grams of Marijuana

A 21-year-old who admitted buying 100 grams of marijuana was sentenced to eight addiction counseling sessions instead of prison.

The defendant had ordered 100 grams of marijuana from a supplier on the darkweb. Customs officers intercepted the package.

Later, police searched the 21-year-old’s apartment in Berchtesgaden and found five more grams of marijuana. They also seized his electronic devices.

During a hearing at the Laufen district court, the prosecution admitted that investigators had not found evidence of drug trafficking. However, the defendant had ordered much more than a “personal use” amount of marijuana, the prosecutor told the court. Additionally, if tried as an adult, the defendant would have faced a minimum sentence of one year in prison.

The defendant argued that he had ordered so much marijuana because he could not acquire it locally. He described the 100-gram order as a supply that would last a long time.

The presiding judge sentenced the defendant to eight addiction counseling sessions, as many as two drug tests, and a fine of 1,300 euros.

Wild a progressive country like germany would even consider a marijuana case to enter the court. I can get 28grams for around 200-400 depending on quality and vendor… so lets say $500-2000 he paid for that 100 grams and how much did that cost the taxpayers?

Your talking hours and hours of investigation… people inside the HQ watching online activity, all the cops who kicked in his door, all the court ppl and judge, the money they cofiscated in fines from him that wont ever enter the economy like it would if they just let him be and buy shit like everyday citizens do. Theres no way the math adds up to be worth it for anyone let alone the ppl who pay money for the cops to keep them safe.

Since “customs officers” intercepted the package, the guy had obviously ordered from outside DE, which is a bad idea for products you can get easily from domestic vendors - you know, because it doesn’t go through customs.

well it doesn’t matter if he denies it or not. opsec rules are to not have anything that would relate you to the offense and thats more then enough for them to find him guilty if he has weed at home when they kick in the door, maybe if there was nothing present deniability would work somewhat but going the route of personal use makes way more sense because there is no evidence of trafficking and deniability would just make it worse. not to mention if his electronics werent encrypted he is done either way.

Ya man, lot of people dealing weed off less than 100 grams out there. Hard to deny a package with your name and address on there. Most likely unencrypted which may have worked to his advantage for the missing distribution, one of the few times I’ve ever seen an OpSEC failure work in someones favor. I feel like the drug rehab is much more fair than 5 years in prison in South Korea.
